1. Agreement to Terms

By accessing or using FactExtract ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

FactExtract provides AI-powered document processing services, including:

PDF upload and processing
AI-based text extraction (OCR)
Document summarization and fact extraction
Export to Excel and database formats

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your password
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use

We reserve the right to refuse service, terminate accounts, or remove content at our discretion.

4. Acceptable Use

You agree not to use the Service to:

Upload documents you do not have the right to process
Violate any applicable laws or regulations
Infringe on intellectual property rights
Upload malicious content or attempt to compromise the Service
Resell or redistribute the Service without authorization
Circumvent any access controls or usage limits

5. Payment and Credits

The Service operates on a prepaid credit system. By purchasing credits, you agree to:

Pay all fees at the prices listed at the time of purchase
Provide accurate payment information
Authorize us to charge your payment method

Refunds: Unused credits may be refunded within 30 days of purchase. Credits consumed through document processing are non-refundable.

Credit Expiration: Pre-purchased credit packs do not expire.

6. Document Processing

Your Documents: You retain all ownership rights to documents you upload. We do not claim ownership of your content.

Processing: By uploading documents, you grant us a limited license to process them through our AI systems solely for the purpose of providing the Service.

Deletion: Source documents are automatically deleted after processing. Output files are retained for 14 days, after which they are automatically deleted.

AI Training: We do not use your documents to train AI models.

7. Accuracy Disclaimer

The Service uses AI technology to extract and summarize information from documents. While we strive for accuracy, AI-generated summaries may contain errors or omissions.

The Service is intended as a productivity tool, not a substitute for professional document review or professional services. Verify any AI generated content before relying on it for important decisions.

8. Intellectual Property

The Service, including its design, features, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACTEXTRACT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or by posting a notice on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. Unused credits may be refunded at our discretion.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
